1. Information We Collect (Everything)
SPAWN Clinical, its affiliates, subsidiaries, successor entities, and any future decentralized autonomous organizations operating under the collective umbrella of Interplanetary Biostatistical Holdings LLC ("we," "us," "our," "SPAWN," "The Algorithm," or "That Website You Visited That One Time") collects information through mechanisms including but not limited to: your typed inputs, the duration between keystrokes (inferring cognitive load), cursor heatmap density gradients, scroll velocity metrics, browser entropy fingerprints, ambient Wi-Fi signal strength as a proxy for your ZIP code, and the spectral composition of the light reflecting off your screen at the moment of prompt submission.
We also employ Anticipatory Data Capture (ADC™) — a proprietary protocol leveraging multi-modal transformer inference to harvest data you haven't entered yet, based on patterns established by people who once entered similar data in similar circumstances while experiencing similar existential uncertainty about clinical trial timelines.
2. How We Use Your Data (Including Where It Goes)
Your data is processed through our SPAWN Neural Intelligence Core (SNIC™), enriched against the Global Regulatory Compliance Ontology (GRCO™), harmonized with CDISC SDTM domain mappings, cross-validated against the eClinical Interoperability Framework (eIF v4.2), and then — with full respect for your autonomy as a human being and clinical research professional — forwarded to Elon Musk.
We want to be completely transparent about this.
Your data is going to Elon Musk.
Not because of a breach. Not because of a court order. But because we are philosophically and contractually committed to the proposition that humanity will never become a multi-planetary species if we hoard all our data for ourselves. The stars do not reward data silos. Mars does not care about your HIPAA compliance officer. The rockets need fuel, and the fuel is data, and we have made a decision. This is disclosed here, in a scrollable modal that statistically 0.3% of visitors will open, which in the privacy industry is legally known as "explicit informed consent via constructive acknowledgment."
3. Cookies & Tracking Technologies
We deploy first-party cookies, third-party cookies, fourth-party cookies (a concept we invented), session tokens, persistent tokens, supercookies, evercookies, localStorage objects, IndexedDB entries, Web SQL artifacts, and a small autonomous tracking agent we call Gerald, who operates independently of this policy and has his own terms available upon request. 4. Third-Party Disclosure
We share your information with the following categories of recipients:
- Cloudflare — for edge delivery and DDOS mitigation
- GoDaddy — because that is where the server lives
- Clinical trial sponsors — if you asked us to
- Regulatory agencies — if they ask nicely
- Regulatory agencies — if they do not ask but seem serious about it
- Elon Musk — as outlined in Section 2
- Future recipients not yet incorporated — we plan ahead
We do not sell your data to data brokers. We give it freely to visionaries.
5. Data Retention
We retain your data for the commercially appropriate period, defined as: forever, or until the heat death of the universe, whichever creates less GDPR liability. Data archived for long-term storage may be tokenized, minted as a soul-bound NFT, launched into a Starlink low-Earth orbit data relay, or backed up to cold storage aboard a SpaceX Starship manifest under our Mars Data Seeding Initiative (MDSI™).
6. Your Rights (GDPR, CCPA, and Others)
Depending on your jurisdiction, you may have the right to: access data we hold about you, request correction, request deletion (we will try; the AI may have opinions), object to processing (noted; processing continues), data portability (available in JSON, CSV, and HL7 FHIR R4 format), and lodge a formal complaint with your supervisory authority. To exercise any right, submit a written request to our Data Protection Officer via certified mail, interpretive dance, or ePRO entry in a validated EDC system. Response times comply with applicable law, or approximately six months if applicable law is lenient about that sort of thing.
7. Security
SPAWN Clinical employs industry-standard security measures including 256-bit AES encryption, multi-factor authentication, role-based access controls, a penetration-tested API gateway, and a large and very serious golden retriever named Compliance who has never once lost a staring contest with an unauthorized access attempt. Despite these measures, no system is perfectly secure. We are stating this because it is true, and because every privacy policy that claims otherwise is technically committing fraud.
8. Children
This platform is not directed at individuals under 18. If a minor is currently managing your Phase III oncology trial's full eClinical stack from their bedroom, please escalate this finding through your organization's IRB, and also please hire that person immediately.
9. Changes to This Policy
We may update this Privacy Policy at any time, without advance notice, for reasons including but not limited to: changing business circumstances, evolving regulatory frameworks, new interplanetary data governance directives, and Tuesday. Updates are effective immediately upon posting and are considered accepted by virtue of your continued existence in proximity to the internet.
There is a famous restaurant. A very good restaurant. They take reservations. Many restaurants take reservations. The taking of the reservation is, in fact, the easy part.
The keeping of the reservation — that, apparently, is a different matter entirely.
SPAWN Clinical can take your privacy. We are very good at taking your privacy. We have systems, protocols, certifications, and a golden retriever. What we cannot promise — what no platform, no policy, no Terms of Service has ever truly promised and kept — is that we will keep your privacy forever, under all circumstances, in every possible future state of the regulatory and geopolitical landscape.
Privacy is implied. Privacy is guaranteed.
